Privacy and image rights

We provide rigorous advice and robust legal defence in matters concerning these fundamental rights. We help prevent risks and react firmly whenever these rights are put at stake.

The unauthorised disclosure of photographs or videos, comments on social media, or the publication of sensitive personal information can infringe a person's honour, privacy or image rights; particularly when there is a commercial purpose, a significant reputational impact, or minors are involved.

At Audens, we protect these rights against improper uses online, in the media or in advertising campaigns, and we act decisively in interferences affecting their public profile or private life. We also advise companies, creators and professionals on the lawful definition and exploitation of image rights, ensuring a secure contractual framework aligned with their needs. We assist in matters such as:

Unauthorised uses

We take the necessary measures to stop the unauthorised dissemination of names, photographs or videos, seeking compensation where appropriate and helping to restore reputational harm.

Talent and representation agreements

We advise artists, athletes, models, agents and managers in the negotiation and drafting of their contracts, as well as in the exploitation of their image and the protection of their professional reputation.

Credit information systems

We defend companies reporting unpaid debts to credit information systems, representing them in claims and strengthening their internal procedures to ensure compliance with applicable requirements.

Media and advertising

We provide guidance to media outlets, agencies, journalists and performers, ensuring the lawful use of image rights and preventing conflicts that may affect reputation or privacy.

Minors

We determine the legal requirements for the use of children's images and assess situations requiring enhanced consent or specific authorisations.

Key experience

We represent one of Spain's largest financial institutions in hundreds of claims alleging unlawful interference with their reputation (right to honour) arising from entries in credit information systems nationwide. Our work has consistently led to favourable decisions.

We led the defence in a claim for alleged infringement of honour following the publication of highly critical information about an organisation. The dispute centred on the balance between freedom of expression and personality rights. The court dismissed the claim, recognising both the truthfulness and public relevance of the information published.

We advised a modelling and events agency on the design and drafting of its agreements, establishing a clear framework for the assignment and use of the image rights of the professionals it represents. We also reviewed the conditions of its digital portfolio platform, contributing to a safer and more transparent selection process for its clients.

We supported a television production company when a participant attempted to withdraw consent to block the broadcast of a completed documentary. We led the negotiation to uphold the validity of the prior authorisation and ensure the work's exploitation without censorship or re-editing.
